These terms and conditions govern your use of the website operated by The Construction Contracts Co. (referred to in these terms as "TCCC", "we", "us" or "our") and any products, free resources or services purchased or accessed through it.
By using this website, downloading any free resource, or purchasing any product or service, you agree to these terms. If you do not agree, please do not use the website or purchase any product or service.
The Construction Contracts Co. is operated by Mat Kennedy as a sole trader based in Brisbane, Queensland, Australia.
TCCC produces and sells commercial advisory materials for the Australian construction industry, including builder-specific Subcontract Management Packs, free templates, checklists and guides, and one-on-one subcontract review services.
All materials and services are commercial in nature. They are designed to help subcontractors understand the commercial implications of construction subcontracts based on the contract terms as written.
Important: Nothing on this website, in any product, free resource, or as part of any service constitutes legal advice. TCCC is not a law firm and Mat Kennedy is not a lawyer.
All materials and services represent the commercial opinion of TCCC based on the relevant contract terms as written at the time of publication. They are general in nature and do not take into account your specific circumstances, the specific terms of any subcontract you have been issued, or any project-specific variations or amendments.
Where legal issues arise, you should engage a qualified Australian construction lawyer. You should not rely on any TCCC material or service as a substitute for independent legal advice.
Free resources made available on this website (including but not limited to templates, checklists, guides, and registers) are provided on an "as-is" basis for general informational and educational purposes only.
You are free to download, use, modify and share free resources for your own commercial purposes, provided you do not:
TCCC makes no warranty that any free resource is fit for any specific purpose, will be free from errors, or will achieve any particular outcome. Use of free resources is entirely at your own risk.
Subcontract Management Packs are digital products delivered as PDF files via the order confirmation email and an automated download link upon successful payment.
Each pack is built from the standard general conditions used by the named builder as at the date of publication. Contract terms may vary between projects and may be amended from time to time. You should always review the specific subcontract issued to you for your project.
The price displayed at the time of purchase is the price you will pay. All prices are in Australian Dollars (AUD) and inclusive of GST where applicable.
By purchasing a pack, you receive a non-exclusive, non-transferable licence to use the pack for your own internal commercial purposes. You may not:
TCCC offers one-on-one subcontract review services. The scope, deliverables and price of any review service will be agreed in writing before the engagement commences.
All review work is delivered as commercial advisory output and is subject to the same "not legal advice" disclaimer in clause 2 of these terms.
Payment terms for review services will be set out in the relevant engagement confirmation.
Because TCCC products are digital and delivered immediately upon purchase, all sales are final. Refunds are not offered for change of mind, accidental purchases, or perceived lack of need after download.
Nothing in this clause limits your rights under the Australian Consumer Law. If a product or service we supply has a major failure or is not of acceptable quality, you may be entitled to a refund, replacement or compensation as required by law.
If you believe a product or service is materially defective, contact us at the email address below within 14 days of purchase and we will assess the issue in good faith.

TCCC products may reference the names of third-party head contractors, builders and other industry participants for the purpose of identifying the contract being analysed. All such references are factual identifiers only.
Any commercial risk assessments or commentary in TCCC materials represent the professional opinion of TCCC based on the contract terms as written. They do not represent statements of fact about the named third party's business practices, conduct, or intentions, and should not be interpreted as such.
